Importance of construction law
In 2019, the construction industry contributed 5.6 % to the overall gross value added of the economy. The proportion of gross domestic product used for construction investment was almost twice as high at 10.9 %. The construction industry's share of total employment was 5.6 %. A total of 373 billion euros was invested in construction in 2019. It is therefore not without reason that it is referred to as a key industry for Germany.
In addition to this economic importance of construction for the community, building a house or buying a home is often the most important economic investment of an individual's life.
The implementation of construction projects does not always do justice to this importance. Stuttgart 21, BER and the Elbphilharmonie concert hall are on everyone's lips. The number of structural damages in new residential buildings has increased considerably since the construction boom began a few years ago. On average, the cost of building damage has risen from 49,000 euros in 2006 / 2008 to just under 84,000 euros today.
Our services
We advise and support public bodies, companies and private investors acting either as clients or contractors in the construction sector in all matters relating to private construction and real estate law.
We advise on the selection of land and purchase contract negotiations. Our legal support continues with the drafting of architects' and engineers' contracts and building contracts in accordance with the German Civil Code (BGB) and the German Construction Contract Procedures (VOB/B) and also includes, for example, advice on insurance options and models. A further focus of our work is legal project support during construction. This includes, for example, supplementary claims management or the identification and rectification of defects during construction. We also take care of securing the claims of the parties involved in the construction project as part of the regular construction process, for example through guarantees, insurance, etc.
The aim of our advice is to avoid construction standstills and the resulting unforeseeable consequences for all parties involved as far as possible. If this does not succeed, we naturally also advise on termination options and settlement procedures during the crisis.
Finally, the legal enforcement of claims before state courts and arbitration tribunals is also part of our field of activity.
We are also appointed as arbitrators in such proceedings.
