Price increases and extended delivery times have been dominating the business news for months. This does not only affect companies among themselves. It becomes particularly interesting when companies have agreed or will agree contracts with the public sector.
Entrepreneurs must be able to calculate their prices and delivery times with certainty. This is no longer working at the moment.
In March, the Federal Ministry of Construction responded to this situation by issuing a decree for federal construction projects, according to which price adjustment clauses are to be increasingly agreed. Other public bodies are not required to do so. However, some have followed suit and are also applying this to purchase contracts or service contracts.
In the case of current contracts, it will also be possible to think about the subsequent agreement of price adjustment clauses or to adjust the contract.
With regard to delivery times, the standard contract templates already contain clauses that provide for an extension of the execution deadlines.
