The public is under the impression that the contract is always awarded to the cheapest bidder. However, the aim of procurement law is actually to achieve the best value for money. Lawyer Weihrauch from Bonn explains examples where it is not acceptable to look only at the price. The European Court of Justice and the Higher Regional Court of Düsseldorf have recently reinforced this. However, the criteria must be factually related.
