What are the possible consequences if a road user causes or contributes to a road traffic accident?

In addition to civil proceedings, which deal with the settlement of property damage and personal injury, criminal or administrative fine proceedings may be initiated. Whenever a person is injured in an accident caused by a driver, the public prosecutor's office will initiate criminal proceedings for negligent bodily harm. The accused is charged with having failed to exercise the necessary care in traffic and thereby causing harm to the health of another person.

What sanctions are imposed in criminal proceedings?

In the case of particularly serious injuries or gross misconduct, the offender may be banned from driving or have their driving license withdrawn, in addition to a fine or suspended sentence. However, in the case of minor injuries, the public prosecutor's office usually discontinues the proceedings and refers the case to the relevant fines office.

What are the consequences of a fine?

If the person concerned has disregarded the right of way, for example, a fine of 100 EUR is set in the fine notice, and 1 point is also incurred in Flensburg. The person concerned can defend themselves against the fine notice within 2 weeks by filing an appeal. The help of a specialized lawyer should be sought.
