When and how a security deposit for a rented property must be paid by the tenant is the first question that our specialist lawyer for tenancy and property law will address. Section 541 of the German Civil Code (BGB) contains regulations here on the three installments that are permitted.

The landlord, for his part, must observe § 515 para. 3 BGB because he must keep the deposit separate from his assets. The deposit must not be kept in the landlord's normal checking account.

The tenant must pay at least two installments of the deposit, otherwise he or she may face immediate termination without notice and without prior warning.
