The ECJ has ruled that the minimum and maximum rates of the fee schedule for architects and engineers are contrary to European law. It is still unclear how the German courts will deal with this.

The Higher Regional Court of Celle has ruled that this also applies to currently pending proceedings.

The Higher Regional Court of Hamm, on the other hand, has awarded the minimum rates in a similar constellation.
