The article deals with the topic of business transfers. If such a change of ownership is pending, this often means a great deal of uncertainty for the employees concerned. In particular, the question of what happens to the existing employment relationship with the transferor of the business is of interest. In order to counter this uncertainty, this article aims to clarify the questions of what is meant by a transfer of an undertaking, what the consequences of such a transfer are for the employees concerned, and whether there are any possibilities for defending against an impending transfer. The main focus here is on showing the affected employees their rights in the event of an impending transfer of operations and clarifying that a transfer of operations does not lead to the end of the existing employment relationship.
