To compile the list of top lawyers and commercial law firms, FOCUS conducted a survey of more than 4,200 specialist lawyers and over 1,700 lawyers from commercial law firms. The deciding factor for the listing was the frequency of recommendations by colleagues. However, online client review portals and further mentions in industry publications or the business press were also taken into account.

From this, FOCUS has selected those lawyers and law firms that have achieved a high ranking in the Germany-wide comparison of publishers, and awarded them the title "Top Lawyer 2013" or "Top Commercial Law Firm 2013" for their respective fields.
